DEFINITIONS AND INTERPRETATION

In terms of this Website and other policies referred to herein, unless the context otherwise indicates:

1. Emco – means Emco Electrical.
2. “You “or “Customer” or “User”– means any person who visits, accesses or uses the website.
3. “Products” or “goods” – means all the goods sold by Emco.

1. A reference to a customer shall include that customer’s successors and lawful assigns. 
2. Words importing the masculine gender shall include the feminine and neuter genders and vice versa.
3. The headings to the various clauses referred to in this Website are provided for convenience of reference only and are not to be taken into account in the interpretation thereof.
4. A reference to natural persons shall include juristic persons, trusts and partnerships and vice versa. 
5. If there is a conflict between the words and numerals in the interpretation of a rule, the words shall prevail.
6. When any number of days is prescribed in this website, the same shall be reckoned exclusively of the first and inclusively of the last day, unless the last day falls on a Saturday, Sunday or proclaimed public holiday in the Republic of South Africa, in which event the last day shall be the next succeeding day which is not a Saturday, Sunday or public holiday.

• We reserve our right to suspend our website or any part thereof or terminate your account at any time if we, in our sole discretion, determine that you are not using the website in compliance with these Terms and Conditions or if we believe the information provided by you is untrue, inaccurate or incomplete.

1. Your access to and use of the emcoelectrical.co.za website is subject to the following Terms and Conditions and these Website Terms and Conditions govern the ordering, sale and delivery of products and goods, and the use of the Website.
2. The products and services offered by or through the emcoelectrical.co.za website and any sales concluded in respect thereof are also made available subject to the following Terms and Conditions.

Registration and use of the website

Only registered users may order Goods on the Website.
To register as a user, you must provide a unique email address and password and provide certain information and personal details to Emco Electrical. You will need to use your unique email address and password to access the Website in order to purchase Goods.

You agree and warrant that your username and password shall:
be used for your personal use only; and
not be disclosed by you to any third party.

For security purposes you agree to enter the correct email address and password whenever ordering Goods, failing which you will be denied access.

You agree that once the correct email address and password relating to your account has been entered, irrespective of whether the use of the email address and password is unauthorized or fraudulent, you will be liable for payment of such order.

You agree to notify Emco Electrical immediately upon becoming aware of or reasonably suspecting any unauthorized access to or use of your username and password and to take steps to mitigate any resultant loss or harm. You may update, edit or terminate your account at any time through the Website.

Conclusion of sales and availability of stock

Registered users may place orders for Goods, which Emco may accept or reject. Whether or not Emco accepts an order depends on the availability of Goods, correctness of the information relating to the Goods (including without limitation the price) and receipt of payment by Emco for the Goods.

NOTE: Emco will indicate the acceptance of your order by delivering the Goods to you or allowing you to collect them, and only at that point will an agreement of sale between you and Emco come into effect (the “Sale”). This is regardless of any communication from Emco stating that your order or payment has been confirmed. Emco will indicate the rejection of your order by cancelling it and, within 30 days thereafter, refunding you for any amount already paid.

Prior to delivery or your collection of the Goods, you may cancel an order at any time provided you do so before receiving a dispatch or delivery notice. After delivery or your collection of the Goods, you may cancel the Sale only in accordance with the Returns Policy

Placing Goods in a wish list or shopping basket without completing the purchase cycle does not constitute an order for such Goods, and as such, Goods may be removed from the shopping basket if stock is no longer available or the price thereof might change without notice to you. Emco shall not be liable if such Goods are not available or are not available at the particular price when you complete or attempt to complete the purchase cycle at a later stage.

You acknowledge that stock of all Goods on offer is limited and that pricing may change at any time without notice to you. In the case of Goods for sale by Emco, Emco will take all reasonable efforts to monitor stock levels and ensure that when stock is no longer available, that offers thereof are discontinued on the Website. However, we cannot guarantee the availability of stock. When Goods are no longer available after placing an order, Emco will notify you and you will be entitled to a refund of the amount paid by you for such Goods. 

Certain Goods may not be purchased for re-sale. Should we suspect that such Goods are being purchased for this purpose, we are entitled to cancel your order immediately without notice to you.

The invoice for your purchase will be emailed to you at the email address you provide to us. A copy of this invoice will be included in your parcel and will also be made available on your registered account.

Emco reserves the right to discontinue or change the specifications of its Goods from time to time without notice to you. However, the specifications of a particular Good will not be changed after order confirmation and before delivery of that Good to you.

These Terms and Conditions are in no way intended to deprive you, if you are a “consumer” contemplated under the Electronic Communications and Transactions Act 25 of 2002 (ECTA) of your right to cancel an agreement for the supply of goods within seven days after the date of the receipt of the goods, subject to a handling fee / the reasonable cost of returning the goods, which will be off-set against the refunded purchase price. You are a consumer under ECTA if you are an individual who will use the goods you buy.

Shipping & Delivery Policy

1. Delivery Coverage
We deliver nationwide across South Africa. Delivery is available to all major cities, towns, and most regional areas. Certain high-risk or remote locations may be subject to courier limitations or alternative delivery arrangements. Where applicable, we will contact you directly to coordinate a suitable solution.

2. Shipping Costs
Shipping is automatically calculated at checkout based on:

• Product size classification
• Order quantity
• Delivery location
• Standard Shipping Tiers (Guide Pricing)
• Final shipping costs are clearly displayed at checkout before payment
• Free Shipping
• We offer free standard shipping on orders over R500.

3. Order Processing

• Orders are processed within 3 business days
• Orders placed before 12:00 PM are prioritised for same-day dispatch where possible
• Orders placed after the cut-off time, on weekends, or public holidays will be processed on the next business day.
• An order is considered dispatched once it has been collected by the assigned courier.

4. Delivery Timeframes
Estimated delivery times from dispatch:

• Local (Gauteng): 2–3 business days
• National (Major metros): 3–5 business days
• Regional / Remote areas: May exceed 5 business days
• Total Estimated Delivery Time
• Local orders: 2–5 business days (processing + delivery)
• National orders: 3–7 business days (processing + delivery)

These are estimated timeframes. Most orders are delivered sooner.

5. Order Tracking
Once dispatched, you will receive a tracking number via email or SMS (where applicable), allowing you to monitor your delivery.

6. Delivery Conditions
Customers are responsible for:

• Providing accurate delivery details
• Ensuring someone is available to receive the order
• If delivery fails due to incorrect information or unavailability, additional delivery charges may apply.

7. Delays & Operational Constraints
While we aim to meet all delivery estimates, delays may occur due to:

• High order volumes
• Courier network constraints
• External logistical factors beyond our control

In such cases, orders will continue to be processed and fulfilled as efficiently as possible. Our timelines are intentionally conservative to ensure reliable delivery expectations.

8. High-Risk & Special Delivery Areas
Certain delivery locations may be classified as high-risk by our courier partners which may affect delivery availability, timing, or cost. Orders destined for such areas may incur an additional delivery fee, which is determined by the courier.
In these cases, we will contact the customer prior to dispatch to:

• Inform them of the additional fee; and

• Provide the option to either (a) settle the fee before shipping, or (b) nominate an alternative delivery address.

We reserve the right to place the order on hold until the customer confirms their preferred option.

• Provide alternative delivery options

9. Click & Collect (Local Pickup)
KwaDukuza (Stanger)
Customers may select Click & Collect at checkout for collection from our KwaDukuza (Stanger) location.

• Availability
• Same-day collection is available for orders placed during business hours
• Orders require a short preparation time before collection

Once your order is ready, we will notify you with collection instructions.

Collection Process: Please bring your order number when collecting. Orders will only be released once payment has been confirmed in full
Collection Timing: Collection times will be communicated directly once your order is ready
Holding Period:  Orders will be held until collected, as all Click & Collect orders are prepaid

10. Local Delivery (Click & Deliver)
Free Local Delivery – KwaDukuza & Surrounding Areas. We offer free local delivery within KwaDukuza (Stanger) and surrounding areas.
Where available, local delivery is prioritised over standard courier shipping.

Eligibility:
Local delivery is automatically made available at checkout for qualifying areas.
Availability is determined based on your delivery location entered at checkout.

Delivery Timeframes: 
Orders placed before 12:00 PM qualify for next-day delivery
Most local deliveries are completed faster than standard courier services
Delivery Process:
Customers will be contacted prior to delivery to coordinate a suitable time
Please ensure availability to receive your order
Failed Delivery

If delivery cannot be completed due to customer unavailability:

• We will attempt to reschedule delivery
• Additional arrangements may be required

Refunds, Returns & Exchanges

Any damaged or short supplied item/s must be communicated within 7 days from receipt of order.
We offer a 30-day FREE returns policy:  If you are not happy with your purchase within the first 30 days of receipt, we will collect the products at our cost, and present you with a full refund. No issue!
For this to be applicable these basic conditions must be met:

• Product/s are returned in their original packaging
• Product packaging is unopened
• Product has not previously been installed and found to be working.
• Product/s remains in a saleable condition.
• Product/s are securely packaged and protected with additional external packaging for transit.
• Any damaged or short supplied item/s must be communicated within 7-days from receipt of order.
• Product/s need to be returned in their original packaging, unopened and in a saleable condition.

If the product packaging is removed, torn open or damaged in any way the product cannot be repackaged and therefore never sold.
The item must be returned in the pristine condition that it was supplied in so that we can re-sell the item.
Any damaged product/s or short supplied item/s must be reported to Emco, in writing, within the 7-day period for the 30-day policy to be applicable.
Once the items are in your possession several things can happen that are outside of our control. Therefore, damages or short supplied item/s reported after the 7-day period from receipt of delivery will be exempt from our 30-day free returns policy.
Emco reserves the right to decline any claims that arise after the 7-day period. A replacement will be at the full discretion of Emco.

Returns and Refunds outside of the 30-day window period:

We are not obligated to accept returns after a 30-day period from the date of purchase. Once the 30-day window period expires, Emco has the right of refusal and can deny your refund altogether. Any agreed-upon handling fees, restocking fees and transport fees are then at our full discretion.
The 30-day window starts counting from the calendar date the order was physically received by you as the customer.

Disclaimer:

Electrical installations must, by law, be installed by a qualified professional tradesperson. Emco will not be held responsible for any claims that arise as a result of non-conformance to building regulations as gazetted and governed by South African law or product failure due to incorrect application or installation.

Emco will not be held responsible for the loss of income, cost of installation, or any other similar instance where costs are incurred due to the malfunction, incorrect supply, or delayed supply of any product.

Returns and Shipping Disclaimer

Customers are responsible for ensuring order details are correct before confirming purchase. If a product is ordered incorrectly, the customer shall bear the full cost of return shipping, as well as a 2.5% handling fee.
We do not accept liability for any loss, damage, or delays that may occur during the shipment of products to the customer, or during the return of products ordered incorrectly. Any grievances or claims related to shipping must be raised directly with the courier company, as they are solely responsible for the safe and timely delivery of goods.

How to return something:

In the event of a return, our courier service provider must be able to access the products within business hours Monday to Friday 8 am – 5 pm.
It is mandatory that the products are securely packaged for transit so that it arrives back with us in the intended condition. If the return cannot be collected either during this timeframe or the exact address we delivered the original order to, you may have to drop goods off at a convenient pick-up point that operates outside of standard office hours. In this event, prior arrangement needs to be made between you and a Emco representative.

Proof of purchase MUST BE presented.

Refunds are processed subject to a final inspection once goods are received back in our store.

How soon will you get your refund?

We have a 7-12 business day turn-around time for the processing of your refund.

The clock starts from the successful collection of your return. We allow approximately 3 business days for the journey of the return to arrive back with us. A further 2 days are allowed for internal processing. The remaining 2-7 days make allowance for funds to be transferred and cleared back into your bank account. Clearance periods differ based on the service provider that you have opted to pay with.

Refunds will be processed by means of the same payment option used for the original transaction: Credit Card to Credit Card, EFT to EFT unless communicated and an alternative is agreed on by both parties.
We reserve the right to decline a refund if the purchase is older than 30 days, excluding a warranty claim.

Product warranties

The Emco warranty is applicable to all products that can be purchased on www.emcoelectrical.co.za. The warranty is valid for a 12-month period from the date of purchase. Proof of purchase must be supplied by the original purchaser. The warranty entitles the bearer to a replacement of the same product. Should an identical product not be available, Emco reserves the right to replace it with a similar product at the same or higher value. Where a Emco supplier has an extended warranty for a period longer than 12 months, we will honour the said warranty in keeping with the supplier’s terms and conditions up to a maximum of 2 years from the date of purchase.

Emco is not obligated to facilitate any repairs or returns after the said warranty period has expired.

Replacement warranty: Emco reserves the right to repair or replace a product with a similar product at the same or higher price, where the original product is no longer available. If the product is returned within the first six months from date of purchase, the product must be returned in the original packaging.

Repairs: Emco will always refer to the original equipment manufacturer, supplier, or service agent for an assessment within the warranty period. Should the original equipment manufacturer or designated service agent conclude that a product has been used outside of its intended use or environment, and a Warranty repair or replacement has been denied, Emco will act on its own discretion and will therefore not be obligated to repair or replace the product. Emco is not obligated to provide a loan item for the duration of the assessment or repair.

Transport cost in relation to a faulty product still within Warranty: In this event, Emco will cover the cost of the collection and replacement transport thereof. However should it be found on assessment that the product is faulty due to abuse or misuse outside of its intended use, it will result in no replacement or refund and therefore the return transport cost from the customer to the supplier, and from the supplier back to the customer, will be levied to the customer and payable by the customer.

Items exempt from the Emco 12-month Warranty:

• Electronic equipment or circuitry susceptible to damage from electrical surges. This includes, but not limited to:
  • Light Bulbs
  • Products with Integrated LED and LED circuitry
  • Consumable and abrasive products
